Google Wins The EU Protected Keywords Hearing

Google has won the EU protected keywords hearing against its long time nemesis, LVMH Luis Vuitton Moet Hennessy that had filed a case about Google infringing on European trade mark. Google still continues its advertisers to allow the use of "protected keywords."
Advocate General Luis Miguel Poiares Pessoa Maduro told the European Court of Justice that Google doesn't go against EU trademark law. He also added that if Google uses protected keywords to serve links to specific products, it will not confuse customers.
He said, "It is important not to allow the legitimate purpose of preventing certain trademark infringements to lead all trademark uses to be prohibited. Since the use by Google does not involve identical or similar goods or services, in principle there can be no risk of confusion on the part of the consumers".
Though, Mr. Maduro gave the decision in favour of Google but at the same time he clarified that Google does not have any right to invoke EU Law unlesss there is a breach in Trademark policy.
